According to the existing state of the law there is no public officer who is expressly charged with the duty of representing the public as the beneficiary of such trusts save 109CZ THE CALCUTTA'. [...] A further drawback from which the book suffers is the entire absence throughout the annotation of any noticeable indication of the text of the sections under review. [...] The general plan folowed by the author in dealing with the suject of company law without special refeence to the sections of the Indian statute gives the book the character of a text book rather than a book meant for the legal prfession. [...] The suit was for a declaration that the peson really interested in certain propissory notes was the Plaintiff and not the Defendant though the notes stood in the name of the Defendant and for the recovery of the notes but not for the recovery of the money due on the notes the makers of the notes were made parties so that the finding may be bining on them also : Held (RAMESAM J.) —That sec. [...] (1) (b) of the Registration Act and in order to find out whether the deed required registration or not—the consideration not having been stated in the deed—an enquiry must be made as to what was the value of the property conveyed and not as to what was the amount of the dower for which the heba was made.
