[...] 71 of the Lunacy Act empowers the District Court to appoint a guardian of the person of a lunatic and although there is no express provision in the Act for giving custody of the person of the lunatic to the guardian so appointed such power must by implication reside in the. [...] Where a conviction is set aside by the Apellate Court on the ground that the trying Court had no jurisdiction to try the accused but does not order a retrial the order of the Appellate Court is no obstacle to the accused being retried on the same charge.
