From the report of the speeches that have appeared :n this press it seems as if the Advocate-General of India spoke on behalf of all the Crown lawyers Sir Tej Bahadur spoke on behalf of the non-official Bar and the Chief Justice replied on behalf of the new Court. [...] the rights of the individual would be treated with no less cosideration than the rights of the State and referring to the Court’s task of interpreting the Constitution Act he said that it would discharge that duty not in a spirit of barren Ieg:ilism but with full regard to the fact that the constitution was a living and breathing organism containing within itself the seeds' of future growth a [...] The Senior Advocates will be entitled to prcedence over the other Advocates and all Advocates inter se in accordance with the date of enrolment in the Federal Court ecept in the case of Advocates enrolled before December 31st 1938 in which case the order of seniority will be according to the date of enrolment in the respective Provicial High Courts. [...] S obtained a decree against the judgment-debtor and in execution thereof he proceeded to attach and sell the house " Cosy Nook." At that time the house was in the possession of a tenant and was not in the occupation of the judment-debtor. [...] 60 (1) (n) of the Civil Procedure Code barred the attachment and sale of the house this was a fit case where equitable execution should be allowed by the appointment of a receiver to act under the orders and supervision of the Court realise the income of the property and after defraying the incidental expenses and his own remuneration to devote the proceeds in satisfaction of the decretal amount
