The learned Standing Counsel appearing on behalf of the Court of Wards took his stand upon the ground that the matter concerned the revenue and that the order had been made in exercise of sovereign functions and as such it was beyond the jurisdiction of Courts of law. [...] 2 of the Court of Wards Regulation X of 1793 the superitendence of the Court of Wards was to etend to the estates of all female proprietors not so exempted by the Government. [...] Secondly the author started with the aim of cobining in his book the good features of all the existing works on the subject and making it self-contained for the benefit of practtioners not enjoying the advantages of a complete library. [...] 34 of the Civil Procedure Code refer not only to the principal sum secured by the mortgage deed but also to the amount due on account of interest which has become a part of principal in accordance with the terms of the deed on the date when the preliminary decree was passed.
