We cannot hoever commend the construction that has been set up for the use of the Commissioner of Affidavits on the Appellate Side partcularly the bar erected in front of his seat on the outer side of which the declarant has to stand. [...] The result of these apointments to the declarant of an affidavit is that he has to describe a semi-circle by his body in order to bring his head-piece down to the level of the hole and he has to peep and keep peeping through the aperture at the Commissioner ensconced on the further side of the bar. [...] We hope the attention of the Hon’ble the Chief Justice and the Registrar will be drawn to the matter and the present construction will be replaced by one of a more suitable type. [...] The matter becomes sensational when over the same case the debtor goes to the ordnary Appellate Officer for further remission and the creditor to the special Appellate Officer and both of them feel determined to tlo justice to the case. [...] in excess of his contractual liability but avances money to a mortgagor and the money is utilised for payment of a prior mortgage whether the money is actually paid through the hands of the mortgagor or is paid through the hands of the mortgagee the latter acquires the right of subrogation only if the mortgagor has by a registered instrment agreed that he shall be so subrogated.
