Or was it which in the context seems more likely that in the opinion of the Judges every Indian witness must be presumed to be a liar and therefore when a member of them deposes to the same effect it becomes difficult for the Judge to listen for the voice of truth amidst a chorus of lids? [...] The fact of the sub-mortgagee being in possession does not affect the position of the mortgagor who has no notice of the sub-mortgage. [...] If the substance of the transactions is found to be a bond fide settlement between the parties then in spite of the fact that the same transaction might be represented in one of its aspects as a dealing with a spes suceessionis it is none the less a real comprmise of disputed rights. [...] But if in such a suit the Court rightly or wrongly refuse to pass a decree against the sons and passes a decree against the father only the decree cannot be said to have been obtained against the father both in his individual capacity and also as representing the sons and such a decree against the father not being a dcree against the sons cannot be executed against them not because they were [...] If however the debt was for illegal or immoral purposes the father cannot represent the sons and the decree obtained in such a suit is nut against the sons and the question of the nature of the debt can be gone into in the execution proceedings.
