4 of the former Act provides that when the period of limtation prescribed for any appeal expires on a day on which the Court is closed the apeal may be preferred on the day that the Court re-opens. [...] As a matter of practice the Munsifs of the Civil Courts and the Sub-Divisional Magistrates of the locality are functioning as Special and Ordinary Appellate Officers although the rules nowhere prescribe that the Munsifs of the Civil Courts and the Sub-Divisional Magistrates should be apointed as such. [...] If the fact of the contract itself is disputed the arbitrators cannot decide the point and the Court in the normal course would refuse a stay. [...] 48 of the Civil Procedure Code a decree which has been passed for more than twelve years cannot be executed but where the decree or an order passed susequent to the decree directs payment of money or the delivery of property to be made at a certain date or at recurring periods the date of the default in such a case shall be the starting point for the period of twelve years. [...] The paternal grandmother of a Hindu minor even though she happens to be the nearest living relation is not the lawful guardian of the minor within the meaning of sec.
