In this case all the mebers of the Court agreed as to the order to be passed and they further agreed as to the power of the Court to apply a Provincial Act passed during the pendency of the apeal. [...] In the case under notice no security was apparently necessary but the Appellant failed to make the necessary deposit for preparation of the record and in the result the High Court made no order admitting the appeal. [...] On referring to the Order on the said subject as set forth in the volume on the Calcutta Appellate Side Rules we find that the date of the Order is not that given by the learned Judge but the 9th February 1920. [...] The principle applicable to the matter has been thus stated : The validity of regulations rules or orders made by executive or administrative departments of the State depends on the due observation of the conditions imposed by the statute as to their making contents and publication; and if the statutory conditions are not coplied with the Court will treat the rules etc. [...] (3) One co-owner can without the cosent of the other transfer his interest or in the case of land his equitable interest to a stranger so as to put him in the same postion as regards the other owners as the transferor himself was before the transfer except that in the case of a transfer by a joint tenant the stranger will become a teant in common or in the case of land a teant in com
