The words of the section cannot both be split up and combined for the purpose of construction contrary to the scheme and spirit of the section. [...] 6 where the words were " the total interest decreed on the loan." These words and particularly the words " on the loan " and the words " included in " distinguish the two cases. [...] Some Courts are taking the view that some prceeding must remain pending at the time when the borrower makes an application for review of decree interpreting the words " pending on that date " as pending on the date of the application of the borrower for review of decree whether this view is correct. [...] By that date the decree must be tested and if the test is satisfied the application would lie although nothing may be pending at the time—provided the application is made within one year from the comniencement of the Act—En ]. NOTES OF CASES. [...] But subsequently the Defendant married another girl: Held (BEAUMONT C. J. and KANIA J.) That the practice which is common in India of arranging marriages between children who are under age is not contrary to priciples of justice equity and good conscience and a suit will lie on such contract by the person who was a minor at the time of the contract if it is for the benefit of the minor.
