36 (1) of the Bengal Money-Lenders Act to bring a suit for relief under the section was not limited to cases where no decree had been passed on the loan at the instance of the creditor but extended even to cases where a decree had been passed. [...] To persons in high and spectacular positions titles come more or less as a matter of course: but in the case of others who have to spend the substance of their lives in the day-to-day toil of routine-work titles can still be rgarded as a mark of worth. [...] What the Commissioner has power to decide is whether a particular person has the status of any of the persons referred to in the section. [...] A share-holder sought to recover from the Income Tax authorities the difference between the amount the Company had paid on the shares allotted to him and what he would have paid if the tax had been levied according to the rate appiopriate to his income : _ Held (LEACH C. J. WADSWORTH and PATANJALI SASTRI JJ.)—That the assessee was not entitled to any refund the distribtion of the bonus share [...] Where an offer is made and accepted through post or telegram a part of the cause of action arises where the letter or the telegram accepting the offer is posted or sent and a part where it is delivered.
