But does he hold an office under the Crown in India "? It is not clear whether the phrase " in India " is to go with " office " or with " the Crown." The term " Crown in India " has nowhere been used in the Act to denote the Sovereignty but similar phrases are not unknown to constitutional parlance. [...] It seems however to be more consonant with the ocabulary of the Act that the words " in India " should be read as going with the word " office." Considerable light is thrown on the matter by Chapter X which deals with " Services of the Crown in India." There at least it is quite clear that the phrase." in India " is used to denote the loction of the service and not the territorial habitati [...] The High Cormissionership however is not one of the Services in India and is not provided for by Chapter X at.all but it is dealt with under Chapter XII termed " Miscellaneous and General." There are only two Services in India known to the Act the Defence and the Civil and the High Commissionership as the Act is arranged comes under neither. [...] The full designation of the High Commisioner is " High Commissioner for India in the United Kingdom " and the office would seem to be an office under the Crown in the United Kingdom though the salary is borne by the Indian Revenue. [...] The communication of the letter to Magistrate does not come under prepa al because the sending of the letter did k any way devise or arrange any means measure for the commission of the offe' that is the starting of the slogan.
