The very soul of honour and above pettiness of every kind it did one’s heart good to come in cotact with him; and the charm of manners which endeared him to everybody was not thd inane charm of an ineffective and a good-for-nothing but the engaging charm of a successful man of the world who was also a gentleman in the truest sense of the term. [...] The moderation and consideration shown to the debtor at the expense of the creditor which styles itself humanity is the sign of a weak epoch —Ihering Struggle for Law. [...] The creditor brought a suit against all the sons and relied on the acknowledgment by the youngest son for saving limitation: Held (Full Bench: LEACH C. J. GENTLE and SOMAYYA JJ.)—That the acknowledment ¶y the youngest son did not bind the others. [...] From the partnership deed it appeared that the extra four annas share was held by the woman on behalf of her minor children who were admitted to the benefit of the partneship as a body and the intention was that the minors were not to take a vested share in the fund but that their rights should be governed by the law of survivorship when the fund would be distributed: Held (LEACH C. J. WADSWO [...] 26A of the Income Tax Act contemplates the regitration of a firm which is constituted under an instrument of partnership which clearly states what the individual shares of the partners are to be.
