In one of them one Khan Saheb Hatem Ali Jamadar a member of the Bengal Legislative Assemly was being tried before a MunsiMagistrate for criminal breach of trust and he moved the High Court for transfer of the case from the file of that Magistrate: It appeared that in connection with the case the Secretary to the Government of Bengal in the Department of Agriculture; Coperative Credit and [...] The Hon'ble the Chief Justice commented severely on the 'grave impropriety of the Government comunications in one case and the action of.the District Magistrate on the other and he gave just praise to the independence show.nby the District Magistrate in the first case and by the Munsif-Magistrates in both. [...] In the other case the Chief Justice observed that if a District Magi* trate withdrew from a trying Magistrate a. case in which the latter was exercising his judicial discretion on the ground that the result was not or might not be the result he wished and sent it to another Magistrate for the express purpose of getting the result he desired then it was not justice according to law and the Magis [...] The application for transfer made by the accused in the first case was refused and the application made by the complainant in the other case was allowed the case being re-transferred to the Munsif-Magistrate. [...] There was a time when any observation made by the High Court on any action of the Government or the conduct of any of its officers was immediately given the fullest effect and if the High Court indicated the course of action to be followed or the steps to be taken in a partianlar matter or a kind of matter the Government governed itself accordingly with the ultmost respect and without demur.
