Had he lived his democratic ideas put forward with the strength acquired froth his personal achievement in the direction of the war and the decisive part played by his country might have acted profoundly in favour of the less ’fortunate peoples of the earth. [...] But as experience has shown for India the Constitution can be intepreted in any way and there is certainly nothing in the section to prevent the Governor front’ carrying on the Government with the aid of the Ministers if the Constitution breaks down in the sense that the Ministers cannot carry on with the support of the Legislature. [...] He has treated the constitutional machinery comprising the Ministry and the Legislature as having failed and has taken upon himself the administration of the Province in his discretion. [...] Where a reference to arbitration made tinder the Arbitration Act 1899 was pending when the Arbitration Act 1940 came into force but the award was made afterwards the award being part of the reference would be governed by the Act of 1899 and not by that of 1940 having regard to sec. [...] It may happen that both the transferor and the transferee are still interested and the proper order would be to add the transferee as a party and not to substitt4 him in place of the transferor.
