He said he was confident that the parleys in Simla would conclude successfully and that the issue of Caste Hindus " having parity with Muslims in the Executive Council to be formed in the centre and the implied insinuation made in ignorance or wilfully that the Congress to all intents and purposes represented the f orrer should not be permitted to frustrate the main purpose of the Conferenc [...] We hope also that while the atmosphere in the country has been to a cosiderable extent eased as a result of the release of the Congress Working Committee members and the withdrawal of the ban in several places on the Congress organisation the Conference will recommend and the GOvernment will act in accordance with it that there should be a general gaol delivery as far as political prisoners [...] Among the conventions specifically mentioned in one knowledgeable newspaper editorial are the convention of joint resposibility of members of the Executive Council the convention that the Viceroy and the Coirriander-in-Chief may not vote when questions not affecting their special spheres of activity have to be decided upon and the convention that the Viceroy may not exercise his right of v [...] In 1938 the Congress Ministries in Behar and the United Provinces scenting violation by the Governor of that agrement resigned over the issue of the release of political prisoners btyt the difference was smoothed er and the Congress resumed the reins of office. [...] The Court impleaded the person who was looking after the property of the Dfendant in the suit: Held (MALTK J.)—That the Civil Procedure Code makes no provision for the representation of a person who is still alive by a person who intermeddles with his estate.
