Speaking of the respective claims and capacities of the people of England and of India to do good to India the Vice-Chacellor titters the following wise and dignified words : " It may indeed be a delusion to assume that India's difficulties will disappear and that the present attitude of defeatism will be automatcally converted into one of constructive optimism on the day when the last Br [...] Sir Elijah Impey who had personal knowledge of the intentions of the draftsmen of the Charter of 1774 which the statute of 1781 did not formally amend laid special stress upon the individual position of Judges as distinct from the Court. [...] But when payment has been made to one of the co-lessors which does not have the effect of discharging the liability of the debtor to the other co-lessors the latter can bring a suit for his share of tlic rent only. [...] If the common intention of the accused is to kill but they give effect to their intention by a series of acts the offence will clearly be one of murder ; the accused succeed in doing that which they intended to do and if the acts folow closely upon one another and are intimately connected with one and another then the offence of murder has been committed. [...] kVhere the accued intended to murder a woman and rob jeer of her ornaments and throttled the woman and then placed the body on the railway line and the woman actually died of the injury received from a passing train : Held (SINIIA and DAS JJ.)—That the accucd was guilty of murder.
