Everything practically hinged on a correct finding on the facts in regard to identification and it was for the sake of getting the decision of the Empire’s highest tribunal on the matter that the case was taken to the Privy Council. [...] 10 of the Provicial Insolvency Act has the same meaning as in the Trusts Act and the words " vested in trust " imply that the ownership of the property has been conveyed to the person referred to in that section. [...] 120 of the Limitation Act applies to a suit for the recovery of trust property from a person who has taken with notice of a trust and in breach of trust and the time begi:7s to run from the date of the knowledge of the Plaintiff.
