The Calcutta Statesman organ of Anglo-India calls it “a leap in the dark” and yet professes to welcome it adding that “it is a great and proud day for this country.” We know however fearmuch of the wiles of our rulers that we fear we have to think thrice before we can on the basis of Mr. [...] Where the rent is payable in kind the landlord is entitled to recover the value of the produce according to the market-value on the date when the produce should have been delivered and not according to that prevailing at the date of suit. [...] Where a decree is passed against the karta of a joint Hindu family as represening the family a junior member of the family cannot sue to have such a decree set aside on the ground of negligence of the karta. [...] There is nothing in the Provincial Insovency Act which prevents the insolvency Court from according sanction to an interim receiver to institute suits even against third parties for the vindication of the rights of the debtor in respect of whom an insovency petition is pending. [...] An interim rceiver is therefore entitled with the santion of the Court to take proceedings to rcover either the goods or their value to which according to the plaint the insolvent and his creditor would be entitled.
