Parmountcy it was argued was the result of agreement ; that the parties to the agrement were the Crown on one side and the States on the other ; that the States tranferred to the Crown the conduct of their foreign relations and the responsibility of defence ; that in consideration of this the Crown undertook to protect the States and their Rulers against all internal and extenal dam [...] As a general rule Paramountcy was exercised by the British Government in India through the GovernoGeneral in Council until the coming into operation of the Government of India Act 1935 in accordance with which the Crown Representative in reltion to the States acts in the name of the Crown either on his own responsibility or under instructions from the British Goernment. [...] Throughout the period of government by the East India Company and by the Crown it was recognised that the Paramount Power was entitled to intervene in the States whenever British imperial interests were at stake or when the machinery was on the point of collapse or when gross babarities were committed. [...] We do not know whether the removal in an unceremonious manner of a qualified Hindu who had been discharging the duties of the (Mice of D. L. H. with credit or the act of pushina non-Baig ali Muslim into the office when an unseemly hurry for the appointment was not really necessary is within the ambit of the funtions of our cartakers or whether such an atrocious act comes under the descrip [...] The choice of Judges as the members of the Commission and the appointment of eminent lawyers on behalf of the interested parties seem to show that the affair of settling the boundary between the two parts of Bengal has been taken to be more or less in the nature of the trial of a parttion suit.
