1948

There is provision also following the usage in the United Kingdom and the United States of America for the attendance of retired Judges at the sittings of the Supreme Court. [...] The facts of the case were tint a police party set out to trap the accused in the act of selling a rvolver; the vccused was actually trapped was searched and taken into custody. [...] It seems to have been argued on the facts that as there was no sanction bfore the police set out to trap the accused or at any rate before he was searched the prosecution was void on the hypothesis that the proceeding was instituted when the police party started on their adventure. [...] It seems from the scheme of the Act that the intention was that in such cases the police cannot act on their own initiative alone but must otain the sanction of the District Magitrate. [...] when a person is found to be in unlawful possession of arms on a search in connection with some other offence the want of sanction in the earlier stage would not make the prosection under sec.
