1948

To I II E EDITOR CALCUTTA WEEKLY NOTES." DEAR SI R In the interest of all concerned I would request you to publish this letter of mine by which I wish to incite the special attetion of the Hon’ble Minister in charge of the Police Department to this still person inundesirable state of affairs in the matter of police investigation of criminal cases. [...] But these statements of witnesses made at the earliest time to a responsible police officer become of great help if reduced 12"tal LUI TINE CALCUTTA into writing to the prosecuting officer and the defending lawyer in helping the Court in determining the truth or otherwise of a paerticular case. [...] 21 r. 100 of the Civil Prcedure Code is not concerned with the dtermination of the title to the property which is the subject-matter of the appliction. [...] 52 of the Transfer of Prperty Act in terms prohibits a transfer of or otherwise dealing with the property in suit by any party to the suit. [...] The result would be that any person claiming to derive title to the property from a party to the suit under a transaction during the pendency of the suit cannot escape from the prohbition contained in that section.
