[...] When an application Lor lease to sue in.forma pauperis is filed in a Court it is to he treated as a plaint and accordingly if a; preliminary objection is raised that the suject-matter of the suit is beyond the limits of the pecuniary jurisdiction of the Court it is its imperative duty to try the issue of jurisdiction in limine and if it finds that it has no pecuniary jurisdiction to decid [...] Where a trial Judge takes the witnesses out of the hands of Counsel and instead takes them into his own hand and assumes to himself the duties and obligations of Counsel by examining and cross-examining the witnesses himself he really puts hiself under a handicap and ttny significance that might attach to the observation of the trial Judge as to demeanour of witnesses is entirely lost to the C [...] It is entirely unbefitting the dignity of the Bar for any Counsel to permit hiself to be made a sort of a pliable instrment in the hands of the Judge.
