The accused had not appealed against the order of refusal but now contended (in the Criminal Court) that the licence had been wrongly refused to him and that bfore he could be convicted the Court should find that the order of refusal had been co-rect on merits. If the order refusing licence were witPout jurisdiction or illegal it was open to the Criminal Court to entertain the plea -against the same but since it was made in the proper exercise of jurisdiction vested in the body and was passed bona fide after considering evidence before it it could not be impugned in the present criminal prceeding as wrong on the merits.
