The correspondent asks can the merchant on the basis of that judgment sue the Dominion in the Court within which the station of booking lies? [...] 80 of the Railways Act that the loss did not occur on that Railway and the dfence succeeds will the merchant on the basis of that judgment thereafter be etitled to sue the other Dominion in the Court within winch the station of booking lies and plead sec. [...] 41 r. 19 of the Code of Civil Procedure the Court should only consider if there were valid grounds for absence on the part of the Appellant on the day the appeal was dismissed for default and cannot rely on any negligence on the part of the Appelant previous thereto in order to refuse restoration. [...] Where one person sues another for rcovery in specie of property wrongfully seized and in possession of Defendants and there is also a claim for the price of the property in the alternative the proper article of the Limitation Act to apply is Art. [...] But where such property had passed on to the hands of third persons a suit for the loss caused to the Plaintiff by the wronful seizure and the sale and the claim is the price of the property sold it is govered by Art.
