Lord Goddard held that the question how far the Court can enquire into the correctness of the decision as distinct from the jurisdition of the Court which decided it depends on the contents of the documents which are brought up under the writ and laid before the Court. [...] The key of the question was the amount of material stated or to be stated on the record returned and brought into the superior Court. [...] The Court is cofined to that which is on the record” and “that supervision goes to two points: one 69OM CALCUTTA 0=14 Acitit Vox« I. N. the area of the inferior jurisdiction and the qualifications and conditions of its execise; the other j the observance of the law in the course of its exercise. [...] The applicant contended that the decision was erroneous on the face of it in that the tribunal had disrgarded the provisions of the relevant reglations as to the calculation of the amount of compensation. [...] This injustice is the greater because the coming into force of the Constitution itself was the cause of these accused being deprived of the rights of appeal which they previously had in and to the Judicial Committee of H. E. It the Nizam.
