Section 50 of the Specific Relief Act had however been adapted so that section 46 of the Act did not affect the power of the Court under Art. [...] While the right to aquire hold and dispose of property inclues the right to enjoy the same the retrictions on the landlord's rights under the Rent Control Act of 1950 was held reallonable in view of the circumstances under which the Rent Acts came to be passed. [...] The scope of section 14(4) of the Rent Act of 1950 was construed as entitling a landlord to the privileges of that sub-section in respect of a suit insttuted before the Rent Act of 1950 came into force. [...] Dhirendra v. Hrishike'sh 55 C. W. N. 594 F. B. disapproved of the prevous Calcutta decisions and pointed out the distinction which exists in respect of dispute which concerns a right to worship generally and the right to worship at a particular place in a particular manner 'which necessarily involves a right to user of land within the ambit of section 147 of the Code of Criminal Procedure. [...] 55 C. W. N. 408 held that when there was nothing in the Articles of Association forbidding a sale by Court of shares held by a meber a sale by Court of the shares had the effect of transferring the shares to the purchaser.
