All India Bar Committee Question Haire : Dual System The All India Bar Committee would soon be enquiring into the question of the continuance or abolition of the dual system of Counsel and Solicitor (or Agent) which obtains in the Supreme Court of India and in the High Courts of Bombay and Calcutta. [...] When the Supreme Court adopted the dual system of Advocates and Agents it did so as a provisional arrangement for two years and the Rules of the Supreme Court point out in a note that the Judges of the Supreme Court have under consideation a proposal to abolish the dual system. [...] The question whether there should be professional division of labour between Counsel and Agent I Solicitor must be answered against the bacground of the experiences of two years' work in the Supreme Court and record of the work of the Original Side of the High Courts of Calcutta and Bombay spread over a long period. [...] While advocating the retention of the dual system in the Original Side of the High Court we do feel however that ythe dual system in the High Court should approximate to the form it has assumed in the Supreme Court. [...] An order passed by the Presidency Court of Small Causes returning a plaint to be presented to the proper Court (because no part of the cause of action :had arisen within the jurisdiction of the Court returning the plaint) is not an oder giving right to the party aggrieved to apply for a new trial under sec.
