The present suit was brought by the Secretary of State against the Defendant for a declaration of right to control water in the fici/d and to obstruct the use of water by the Defendant under the provisions of the Bombay Irrigation Act. [...] The following judgment was pronounced by the High Court :— There can he no question as to the correctness of the general principle adopted by the Court below that the compensation has to be apportioned among the claimants in proportion to the values of their interests in the property acquired by Government (See Rays Kishory Dassi v. Nilkarit Das 20 W. 370) and that the value of the interest of [...] Pratt has calculated the sum of the present values of the profits of the lessees for the years for which the lease has to run; he has dducted therefrom the present value of the salamis or bonuses due to the lessor and has further dducted two-thirds of the cost of erecting the prposed buildings plus one-half of one third or onsixth of the same amount that is in all five-sixths of the [...] So that the lessees' share of the compensation-money is obtained by deducting from the sum of the prsent values of their profit for the unexpired years of the lease the present value of the salami and the cost of erecting the buildings and then increaing the amount by one-half of one-third or onsixth of the said cost.
