The posts of the Master and Official Referee and Assistant Registrars on the Original Side and the strengthening of the ministerial were santioned by the Government of India on the reprsentation of the late Chief Justice. [...] 4 of the Succession Certificate Act no Court shall pass a decree against a debtor of the deceased person in favour of a person claiming to be entitled to the effects of the deceased except on the production by the person so claiming of a certificate issued wider the Act. [...] On the reopening of the Calcutta High Court on the 17th of November last all the Judges and members of all sections of the legal prpfession assembled in the Chief Justice’s Court room as a mark of respect to Sir Francis Maclean the news of whose death had be n received in the week preceding the reopening of the Court. [...] The note was excuted by the latter in favour of " C agent of P." The endorsement in favour of the Plaintiff was signed merely ' C.' Held--That the note being executed in favour of C in his character as agent of P the endorsement by him in his individual capacity and not as agent of P would not entitle the Plaintiff to maintain the suit. [...] The remaining question was whether the fact that the Defendant was born in the colony of Victoria entitled the Plaintiff to contend that the jurisdiction of the Victoria Court over him would be recognized when he was sued in this country on the Victorian judgment.
