(8) as in the Bill an application for adjournment can only be made as under the existing Code by the Public Prosecutor the complainant pr the accused " but if miscellaneous proceedings under the code are expressly included within the purview of the section it seems to follow as a matter of course that the parties thereto who do not come within the category of " the Public Prosecutor the compl [...] His Lordship held that a trial is said to commence when a case is called on with the Magistrate on the bench the accused in the dock and the representatives of the prosecution and the defence if the accused is defended are present in Court for the hearing of the case. [...] The defence was that the mortgage deed was passed in order to protect the property from the Defendant's creditor R. The Defendant stated in his evidence that the consideration for the deed was rceived in the Registration Office and repaid to the mortgagees outside the office. [...] In an appendix are reproduced the repealed Acts beginning from Act XLII of 186o the statement of the Objects and Reasons of the Bill which passed into the present Act the Report of the Select Committee thereon and an abstract of the Proceedings of Council which led up to its enactment. [...] the adaptation of the provisions of' the Indian Codes to the needs of students of law and the exposition of the principles upon which they are based for their benefit.
