1914

The Report of the Calcutta Prisoners' Aid Society which was laid before its General Comittee at a meeting held in the Sessions Court of the Calcutta High Court on Friday Past shows a steady advancement of the objects of the Society. [...] The state of the law as understood at the time is evidence to be considered with the other evidence in the particular case in determining what the Court intended to sell ann what the purchaser understood that he bought. [...] In determining the question of what the Court intended to sell and the purchaser understood he bought evidence as to how the parties affected by the transaction themselves viewed it at the time is of much greater value than evidence which may be procurable some twenty years after the transaction took place. [...] SIR Complaints as to the length of time some cases have appeared on the Peremptory list of defended cases have been brought to the attention of the Hon'ble the Chief Justice and the Judges on the Original Side. [...] In all cases therefore appearing on the Peremptory list the parties must be prepared to go to trial and applications for adjournment will not be entertained on the ground that the parties-are not ready either by reason of the absence of witnesses or the difficulty of obtaining the services of their Counsel or otherwise.
