Before such a resolution is moved the Hon’ble Member should satisfy himself that the general public and the people particularly whose property rights and interests are likly to be affected by it demand the establishment of such a Court in supersession of the jurisdiction of the Original Side of the High Court. [...] Ray is not a resident of the town of Calcutta and before moving any resolution for ousting the jurisdiction of the Original Side in respect of properties and transactions situate or arising witin the statutory limits of the town of Calcutta he must take steps for the ascertainment of the opinion of those who are likely to be affected for good or evil by this proposal. [...] The prestige of the position of a High Court Judge and also the traction of the Bar that when any of its members is called upon to serve on the Bench he should not refuse a judgeship make it comparatively easier for the State to secure desirable Judges for the High Court Benches. [...] On the Civil Side of the Court the Code of Civil Procedure expressly exempts Advocates of Chartered High Courts from the obligation of filing vakalatnamas but on the Ct imintd Side of the Court the Advocates and Vakils have been placed on exactly the same footing and the practice of requiring vak ilatnamcs from one class of practitioners and exempting the other class from this burden has no ju [...] This has been very detrimental to both the members of the English Bar and the Vakils of the Court all of whom popular opinion regards as having been left by the Judges in the cold shade of neglect.
