449) held that it had no jurisdiction under article 226 of the Constitution because the suject-matter of the industrial dispute and the parties thereto were all ouside the jurisdiction of that Court. [...] In deciding the question of its jurisdi tion to quash the impugned order against the Petitioner the High Court felt itself bound by the aforsaid Supreme Court decision. [...] The Bobay High Court held that it would have no jurisdiction to issue a writ to quash the order of the Appellate! Tribunal located in Bombay in the case because the subject-matter of the Industrial dispute and the parties thereto were all outside the jurisdic. [...] The Madras High Court on the other hand held that though the Tribunal is situated outside the territorial jurisdiction of the High Court if it purports to execise the jurisdiction in regard to paties or the subject-matter which are within the territorial jurisdiction of the High Court the Tribunal must he deemed to have functioned within the jurisdiction of the High Court and the jurisdi [...] 26 can be got over by providing for the eforcement of sanctions through the High Court which has territorial juridiction over the Tribunal as in the case of enforcement of oi4ders and decrees of one Court in the territory of another Court.
