It is quite true that in the case of some members of the profession the results of striking an average cannot be a fair index of their prfessional status but on the other hand the average would flatter a good many. [...] It is not the mere depriving of a husband for a day or I ;vo of the society of his wife which gives rise to this action ; it is the fact that the Defendaet has acted in a way towards the wife of the Plaintiff which is illegal and which he is not entitled to do. [...] If the application ripens into a plaint then the date of the institution of the suit shall relate back to the date of the filing of the application to sue in forma pauperis. [...] In such a case the suit shall be deemed for the purpose of limitation to have been instituted on the day the court-fee is paid. [...] The mother Of the sons carried on the business with the help of an agent in the firm name.
