We must acknowledge that considerable improvement has been effected in the matter of supplying copies of judgments and dcrees of the High Court but the standard of promptitude and the degree of conformity with the rules is still regretably below those obtainint in the lower Courts. [...] This difficulty might have been avoided if Rule 37 of Chapter XIII of the Appellate Side Rules had been followed in practice That rule lays down that when a copy of a judgment or decree or order is granted a number of particulars must be recorded on die back of the copy itself namely (i) the date of application (ii) the date of notifing the requisite number of folios and stamps (iii) the da [...] But if the attitude which the Plaintiff adopts is that he merely desires to recover possession of the land and that the payment of the purchase money to a party who was not entitled to receive it is no concern of his then he is entitled merely to an order for recovery of possession with mesne profits from the date of the.suit. [...] 55 (b) of the Transfer of Prperty Act a buyer who has paid a sum of money in advance to the seller is entitled to a charge on the property as against the seller and all persons claiming under him to the extent of the seller's interest in the property for the amount of any purchase money prperly paid by the buyer in anticipation of the delivery. [...] A of the Prvincial Insolvency Act the Court can in a proper case make an order for the examintion of s person even after the discharge of the insolvent.
