In the course of our comments on the Crimnal Law Amendment Bills which are so much before the public now we referred to the rcent judgment of his Lordship the Chief Justice of the Calcutta High Court in the case of Monindra Mohon Sanyal and ors. [...] In this case the grantee of the permanent sublease by the raiyat sued for possession on the ground of the superior lanlords having resisted the Plaintiffs in obtaiing possession. [...] In the case in 6 C. W. N. 916 the represenative in interest of the grantor of the permanent sublease brought the suit against the sulessee. [...] 2 must be held to have been enacted for the benefit of the superior landlord only as are the first and third sub-sections and the sublease in contravention of the second sub-section is void only against the superior landlord and not so against the raiyat. [...] 2 must be read and understood in the light of the proposition of the Full Bench that all holdings are transferable by the raiyat and the lease by the raiyat which is nothing but' a species of transfer " is operative against the grantor and thus the sub-section must be taken to be limited to the case of the superior landlord only who alone can question its violation as he can question every mode
