Besant’s appeals against the decision of the Madras High Court and the orders of the Presdency Magistrate of Madras under the Indian Press Act top the list. [...] followed Jarip Khan's case and held that the permanent lease by a raiyat is void and therfore Plaintiff cannot rely upon any other evdence in support of the transaction and therfore admission of the raiyat of having granted the permanent sublease on receipt of salami and also of possession of the under-raiyat of other lands of the sublease is inadmissible to prove Plaintiff's tenancy with [...] I have reserved to the last the review of two cases in which the doctrine of estoppel was applied to the case of the void sublease. [...] All the elements of Estoppel are thus to be found in cases of permanent sublease unless of course the grantee succeeds in proving that the misrepresentation in the instrument did not make the grantee change his position as he was well aware of the state of things. [...] According to the construction of the mortgage-deed the Plaintiff was to have the usufruct of the 4.bighas and 12 cottas together with Re.
