The learned writer shows that “ the old Roman commonwealth was organised politically on the basis of race and economically on the basis of collective owneship.” It was only after Rome acquired a vast Empire that the State superseded the nation and individual ownership ownership by the community. [...] No peasant had the rights of a Russian subject unless he was a member of a mir and all the land of the peasants were owned by the mir. [...] It was only after the emancipation of the serfs that the lands were divided between the mirs and the lords but the peasants never acquiesced in the division. [...] There are very little comentaries rn the Act the author's plan being to cite Indian decisions to explain the general scope of a section and then to take the coponent parts of the section and similarly note the judicial interpretation put upon them by the Indian High Courts. [...] The words of the consent petition were as follows :—" After 1316 B. S. I with my sons grandsons and other heirs and successors shall go on paying to the Plaintiff and her heirs and successors-in-interest. the amount which may be assessed for the said land in my possession in accordance with the rate prevaii ng in the neighbourhood." The suit was decreed by the first Court.
