In both the above cases the monthly teancy commenced on the 2nd of the month and so the month of tenancy expired on the 1st of the subsequent month and this so as the date of commencement (i.e. [...] The above cases are not authorities for the proposition that if a monthly tenancy comences on the 1st of the month it expires on the 1st of the subsequent month. [...] In such case the 1st of the month is taken into cosideration in computing the month and the month of tenancy expires on the last day of the month. [...] Whether the Insolvency Court would elect to try those questions of title which have been raised bfore it in the proceedings initiated by the application of the Official Receiver or relgate the parties to the ordinary tribunals is a matter for that Court to decide according to circumstances of the case. [...] Therefore the balance will not belong to the Official Receiver and in the absence of any clear provision to the contrary it would be justifiable to award it to the decree-holder who has incurred the expenses of bringing the property to sale.
