The first two subjects on whicn the Comittee reported were the rule that a personal action dies with the person and the rule as to the recovery of interest in civil proceeings. [...] Provided that the Plaintiff shall not be entitled to levy execution for or to be paid a sum exceeding in the aggregate the amount of the first judgment obtained against' any of the persons so liable nor to recover the costs of any subsequent action unless the Judge before whom it is tried is of opinion that there was reasonable ground for brining It. [...] 145 the Magistrate has without ference to the merits of the claim of any the parties to a right to possess the su:et of dispute to decide whether any and Inch of the parties was at the date of the rder initiating the proceeding in possession the said subject. [...] The Defendants objected to the -plaint on the ground of non-joinder of the other brothers alleging that the three constituted an undivided Hindu family and that therefore the suit as framed was not maintainable. [...] Thereupon the Plaintiff filed an application for amendment of the plaint and prayed that he should be described in the plaint as manager of the joint family : Held (SHINGNE J.)—That the manager of a joint Hindu family may sue or be sued as representing the family in respect of a trasaction entered into by him as manager of the family or in respect of joint family prperties.
