An appeal was preferred by the President in due course and certain other developments followed in quick succesion such as withdrawal of the orignal Plaintiffs and the entry of others but bfore the unique point of constitutional law could be finally decided by the Court of Apeal the Government of India and the Secrtary of State intervened and amended the rule relating to the presen [...] The cats that are seen in the afternoons in the corridors of the first floor of the High Court appear to be of the right type and properly famised. [...] In such cases a cause of action arises when the vendor or any person who is entitled to the benefit of the contract with the vendor is actually damnified by the sale of the property by the mortgagee and limitation under Art. [...] The daughter therafter brought a suit claiming the amount of loss which she had suffered as a consquence of the sale of the property against the transferee: Held.(DHAvLE and AGARwALA &E)-- That the daughter was entitled to the benfit of the contract by the transferee. [...] After the parttion the brother who executed the hannote made payments towards the loan and endorsed the payments on the back of the note: //04 (MADHAVAN NAIR and STODART JJ.).
