(6) of the section where it is said that an order restoring possession of the land to the mortgagor “shall have the effect of a decree of a Civil 'Court.” Does that mean that as a decree the order will be liable to the incident of appealability? [...] An extradition warrant was issued by the Political Agent to the Government of India for the arrest of certain persons in Madras and the order further was that the arrested persons should be delivered at the frontier police station for production before a Magistrate in Travancore. [...] It is unnecessary to review the subsquent proceedings in the High Court cuminating in a decision of a Full Bench which repelled the aforesaid contention and in an order by the Criminal Bench in acordance with the Full Bench ruling setting aside the order of Pandrang Row J. When the case was taken before the Judicial Comittee the same contention was raised again and the same argumen [...] Since the above is the decision of the Judicial Committee the question as we said at the beginning of this article is laid to rest. [...] 45 r. 7 o the Civil Procedure Code is to limit the discretion of the Court in granting further time to a maximum period of sixty days beyond the ninety days which the aplicant has of right and if that provision stood aione the Court would have no dicretion to grant time beyond the further period of sixty days.
