The Calcutta Law Journal Short Notes of Cases Articles & Other Matters December 16 1913

1913

The Calcutta Law Journal was started in the year 1905 with the Permission of the Calcutta High Court under the auspices of -a strong and representative Editorial Committee and with a staff of Reporters from all the different branches of the Profession. [...] The peon in question made the attachment after the expiry of the time fixed by the Nazir but before the date fixed by the Co.urt. [...] The only remedy of the plaintiff if the plans have been rejected mala fide is an appliction under section 45 of the Specific Relief Act for an order to compel the Chairman and the General Committee to hear the matter in the manner provided by the law. [...] The question in this case was whether the Civil Court acting under Order XL of the Code of Civil Procedure has power to appoint a Receiver in supersession of the Receiver appointed by the Magistrate under clause (2) of section 146 of the Criminal Procedure Code. [...] The first case however turned on the language of section 145 and not section 146 and in the second though the High Court there refused to interfere with the management by the Magitrate of the property attached under section 146 the point now before the Court did not arise.
