As is pointed out by Slesser L J approving and adopting Bower on defamation in order to prove defamation in a secondary sense ' it is necessary to show not only knowledge of special extraneous facts on the part of the defendants but similar knowledge on the part of the class of persons to whom the matter is published ' together with a further knowledge on the part of the defendants that the [...] The announcement causes in the minds of certain witnesses very natural questionings as to the status of the lady who is known to the world as Mr. [...] Cassidy acceded to the defendants' request to publish the statement he became principal and the defendants became agents The unsatisfactory result seems to follow that of the two publishers of a libel the one who had the means of knowing that the a pparently innocent statement was defamatory is the one who escapes scot-free. [...] It is not for me or anybody other than the legislature to say what provisions of the statute are defective in the protection of the just rights of the landlord or the tenant.
