Instead of the serious enquiry which in the light of modern knowledge such a trial should be it is little else but a battle of wits in which the Judge tends to play the part of a referee at the expense of the more honourable and dignified role of a wise and socially-minded humanitarian engaged with a problem in the life of a fellow creature.
