(3) If the Collector and the occupier differ as to the suffciency of the compensation or if the Collector and two or more claimants for compensation differ as to the apportionment therof the Collector shall refer the matter to the decisiOn of the Court. [...] Now the respondent's claim to the Provident Fund amount was contested by the appellant the heir of the deceased subscriber on the ground that the effect of nomnation was merely to entitle the nominee if he survived the suscriber to receive the money. [...] Clause 12 of the Letters Patent of the Bombay High Court which is identical in terms with clause 12 of the Letters Patent of the Madras and Calcutta High Courts and corresponds to clause TO of the Letters Patent of the Rangoon High Court has been variously interpreted by the several High Courts and the question of amending the clause is under the consideration of the Government.
