Under the limitations set forth above the law allows the exercise of the right to the "Voluntary causing of death or of any other' harm to the assailant if the offence which occasions the exercise of the right be (1) [...] Nor is it merely in subtle disputation of technicalities and form that the two sides to a question are to be found for the learned Judge further assures the aspiring youths that " The surest course to success in the trial of a cause is a strong presentation of the facts of your case in the light of right and justice ; impress on the Judge whether it be the Trial Judge or the Appellate Court tha [...] 153 wfiere an order held invalid excluded from the courtroom all persons except the officers of the court and the defendant ; but the court on appeal admitted that there was no absolute right of all persons regardless of the conveniences of the court and the due and orderly conduct of the trial and that the constitutional provision for a public trial must have a fair and reasonable constructio [...] In the leading case of Surendranath Banerjee v. The Chief Justice and Judges of the high Court (1) Sir Barnes Peacock in delivering the judgment of the Judicial Coemittee observed : That part of the Common Law of England was intrduced into the Presidency towns when the late Supreme Courts were respectively established by the Charters of Justice. [...] The High Courts in the Presidencies are Superior Courts of Record and the offence of contempt and the powers of the High Court for punishing it are the same there as in this country not by virtue of the Penal Code for British India and the Code of Criminal Procedure 1882 but by virtue of the Common Law of England."
