And of course the physician has a right to point out the affects of particular punishments on both the body and the mind of the person who undetgoes them. [...] As a matter of practice he may take the advice of the Executive officers of the Crown for the time being but the responsibility is entirely his own. [...] will in no case where the death Setence is passed relieve the Governor of the duty of deciding as to whether it shall actually be enforced—since the 45th section of the Charter of Justice enpcts that no such sentence shall be carried into execution until a report of all the proceedings upon any such trial bath beedlaid before the Governor by the presiding judge nor until. [...] With regard to a remark made in the afore-mentioned article in the Cape Times that a judge usually advises the prisoner to withdraw his plea of guilty " the duty of the judge is to advise neither the accused nor the Crown. [...] It is a Digest of all the reported decisions of the suprior English Courts including a selection from the Scottish and Irish with a collection of cases followed distinguished explained and commented upon overruled or questione41 and References to the Statutes Orders and Rules of Courts passed dpring the year.
