[...] From the closing decade of the 17th century the actions of the executive have been subject to the test of legality in the Courts of Law. [...] 13 decisions of the Law Courts and in the slossaries of commentators you will see consecutive chapters of the narrative of the progress of the human race. [...] But even so there is still the broad and vital fact poined out so clearly in Lecture XI of Dicey's " Law and Public Opinion " that nintenths of the law of contracts and almost the whole of the law of torts is not to be discovered in the Statute book but in the decisions.
