The petition set forth j the proceedings taken in India under a decree of the Zillah Court of Rungpoor of the 26th of une 1837 and in which the ancestors of the Respondents were interested and stated generally the facts of the case submitting that the proceedings and Order of the High Court refusing leave to appeal were irregular and contrary to law. [...] GORSE MO NEE DOSSEE V. IUGGUT IN DRO NARAIN CHOWDERY the Petitioners were precluded by the practice of the Court and their interpretation of the Order in Council of the ioth April 1838 and of the Charter of the High Court from obtaining the leave of such Court to appeal to Her Majesty in Council; that the value of the subject matter in the original decree of the 26th 9une 1837 was at the da [...] The plaint stated to the effect that it was agreed between the Appellant and his co-Defendant of the one part and the late Kistomohun Bhutto the father of the Respondents Sizamachurn Bhutto Kalchurn and Bhowaneechur 71 and of Oomachurn Bhutto deceased of the other part that the Putnee should be taken jointly by them from the Maharajah the Zemindar in the following proportions viz. [...] On the 22nd of November 186r the first Respodent instituted a regular suit in the Court of the Principal Sudder Ameen against the Appellant and the judgment-debtors Doorgapersaud Dey Russickloll Dey and Prosonomoye Dossee for the sale of Lot Satgachia in execution of the decree in the suit No. [...] The principal Slade A meen fixed the following issues in the cause :— Is the Talook that was rleased by the summary decision complained of the property of the judgmendebtors and therefore saleable in reversal of the Order or is it that of the Claimant Defendant ?" The suit was afterwards removed to the Civil Judge of the Zillah of East Burdwan.
